  1. General provisions

Please read these General Terms and Conditions carefully before purchasing products on the website www.visionbeachtennis.it. By purchasing products on this website, the user automatically accepts these General Terms and Conditions.

Please note that if products have been purchased as part of a promotion certain general terms and conditions may apply, which we will refer to separately as part of the relevant promotion.

  1. Order procedure and conclusion of the contract

2.1. We deliver orders worldwide. The order process in our online shop is divided into the following steps:

• first, the user chooses the desired products;

• then, you must enter your customer data, including billing and delivery address (if different);

• in the following phase the payment method must be chosen;

• Finally, you have the opportunity to check all the data provided again (eg name, contact details, payment method, items ordered) and correct them if necessary. The user can then send us the order by clicking on "Buy now" and then confirming it and accepting these general terms and conditions.

2.2. All information on the website is only an invitation to treat. In other words, the information does not constitute an offer or a binding contract. By placing an order, you are making a binding offer to us to enter into a sales contract with you. All orders submitted by the user must be accepted by us. This automatic order confirmation shows that we have received your order but does not constitute an acceptance of it. The acceptance of the order will be communicated with a separate confirmation email or with the delivery of the products ordered. A binding sales contract is confirmed when the shipping confirmation email or the order itself is dispatched. Together with the delivery confirmation, we will send all the details of the order and information for payment and customer support. Attention: partial shipments are also possible. In this case, the sales contract is only valid for the products confirmed in the delivery confirmation. The user will be informed separately with a message of a future delivery of the missing products.

2.3. The user guarantees that the information provided in his request or order is correct and complete. We may pre-check an order at any time and/or refuse an order without giving reasons and without any liability to you or any third party. If we do not confirm acceptance of the order within ten working days, the order will be considered rejected. At our discretion, we may decide not to accept your order. If we do not accept an order (or any part of it), we may cancel it in whole (or in part) without assuming any liability to you or any third party. Naturally, following cancellation, we will refund you the amount paid for the canceled order or for the canceled part.

2.4. We will not store an accessible copy of this Sales Agreement and therefore we encourage you to download, save and/or print a copy of the Delivery Confirmation and these General Terms and Conditions for your own records.

2.5. If, for some reason, following the conclusion of the contract, we are unable to deliver the ordered products due to unforeseeable circumstances, we may terminate the contract. We will promptly notify you by email and refund any payments made.

2.6. We ask for your understanding that the sale and delivery of products can only take place in domestic quantities.

3.1. The user can place an order in our online shop even without opening an account ("Guest User"), provided that he enters the requested data when ordering. However, you also have the option of opening an account with a password ("Registered User"). In this case, your personal data will already be stored and will not have to be entered again to submit an order. The user also has access to the "My Account" section, where he will find a complete overview of his profile, orders not yet delivered, previous orders and all shipping and payment details. 3.2. If the user wishes to open and use an account on our website, it is his responsibility to ensure the confidentiality of his account and password and to limit access to his computer. In addition, to the extent permitted by applicable law, you agree to all activities conducted under your account or password. We invite the user to take all the necessary precautions, aimed at guaranteeing that his password is kept secret and stored in a secure way, and to inform us promptly if he has reason to fear that a third party has come to know his password or that his password has been used without authorization, or if he believes such unauthorized use is likely.

  1. Order tracking

You can trace your order using the tracking number in your delivery confirmation email from our courier service provider. You will then be able to access our courier's website, which contains updated information about your order and its delivery.

  1. Prices, shipping costs

5.1. All prices include VAT to 22%, unless indicated separately. Barring obvious errors.

5.2. Vision calculates the delivery and shipping costs separately for each delivery address. For some countries it is possible to send orders without shipping costs for purchases starting from a certain amount. For more details, see our shipping policy. The user will be able to view the costs due for the delivery of his order before proceeding with the confirmation of the same. We will accurately indicate the price calculation of the products and the final price before the user confirms the order. The total delivery costs will then be calculated automatically and will be displayed before concluding the order.

5.3. In the case of deliveries to countries outside the European Economic Area, the user will have to bear all import and export costs, as well as any duties and commissions.

5.4. Whilst we make every effort to ensure that the details on our site are accurate, errors may occur in product presentation, description of specifications or quoted selling prices. Where we become aware of an error, we will have no obligation to accept or fulfill an order for an incorrectly advertised product and we reserve the right to cancel orders which have already been accepted or are in transit. In this case, we will notify you as soon as possible of our non-acceptance of the order and/or the cancellation of the relevant part of the order. If you have already paid for the products, we will refund the full amount as soon as possible. Where products are recalled in transit we will refund the amount paid when the products have returned to us.

  1. Transfer of risks

In the case of contracts which provide for the delivery of the products by us to the user, the risk of loss or damage to the products passes to the user when he, or a third party indicated by him who is not the carrier, takes possession of the products. However, without prejudice to your rights against the carrier, the risks pass to you upon delivery of the products to the carrier if you have commissioned the carrier and we have not offered this option.

7.1. Payment Options

7.1.1. Credit cards

We accept the following credit cards: Visa Card, Master Card, American Express.

For a credit card payment, choose a card type, enter your name, credit card number, expiration date and the last three digits on the back of the card. The order will be shipped, once the accounting department has received the payment, in accordance with the usual delivery times indicated in the general contract conditions.

You confirm that you are the holder of the credit card used and that all data provided to us in this regard, including, but not limited to, name and address, are complete, correct and accurate. The user also confirms the validity of the credit card and the correctness of the payment details entered. We are not responsible for any fees or other charges charged by your card issuer or bank as a result of our processing your credit card payment, in accordance with your order.

7.1.2. PayPal

PayPal is an online payment service that allows you to make payments safely, easily, quickly and without additional costs. If the user opts for PayPal, we will redirect him to the PayPal pages after sending his order. The user can log in with his PayPal access data or create a new account (registration and further information at www.paypal.com).

7.1.3. Other payment methods

The user will be able to view the various payment options available for his purchase before submitting the order (e.g. in the footer, on the respective product page and/or on the checkout page).

We reserve the right to add or remove payment methods at our discretion.

7.2. If, for any reason, the amount payable for the customer's order cannot be collected, the order will be cancelled.

  1. Retention of title

The delivered products will remain our property until you have paid all amounts due under this contract with us, including payment of costs, including for early or subsequent deliveries or partial deliveries. You may not sell, dispose of or levy any charges on the Products before ownership has passed to you.

  1. Information on returns and withdrawals

9.1. The user has the right to withdraw from the contract, without giving reasons, within 14 days from the day on which he or a third party appointed by him, other than the carrier, took possession of the products

9.2. To exercise your right of withdrawal, you must inform us by email at: info@visionbeachtennis.com in due time of your intention to withdraw from this contract.

9.3. In case of withdrawal, the products must be returned within the last thirty (30) days from the day they were received. The deadline is considered met if the user sends the products before the deadline of thirty (30) days.

If you wish to return a product purchased as part of a buy one get one free promotion, please note the following: if you return the paid product, you must also return the free product at the same time, otherwise we will apply the corresponding amount and deduct it from the one to be repaid.

9.5. The user shall treat the products with due care. He will be required to compensate for a loss in value if this is attributable to use on his part which is not necessary to verify the quality, characteristics or functionality of the products. We expressly reserve the right to deduct any damages/loss of value from the amounts we will be required to reimburse.

9.6. If you cancel the contract, we will refund you all payments for products purchased and returned (excluding delivery costs). This refund will be made immediately or, depending on the situations mentioned below, no later than fourteen (14) days from the day we receive your notice of withdrawal. For this refund we will use the same payment method used for the original transaction, unless explicitly agreed otherwise with the user. We will not charge you any other fees for such refund. We may refuse the refund until the product has been delivered to us.

9.7. Vision does not offer the possibility of directly replacing the ordered products. If you do not wish to keep the products, you can send us a cancellation notice and the products, in accordance with our returns information and simply place a new order to receive the selected products in a different size or colour.

9.8. Exclusion of the right of withdrawal

The right of withdrawal does not apply to contracts relating to:

• delivery of products manufactured according to consumer specifications or clearly personalized;

• delivery of sealed products unsuitable for return for reasons of health protection or hygiene and opened after delivery;

  1. Warranty and Liability

11.1. Before ordering products from this website, the user is requested to read the general and special information relating to the respective product (in particular, but not limited to, information on the characteristics, selection, maintenance and use of the products , as well as their safety) listed on our website and the instructions contained in our manuals.

11.2 Our liability explicitly applies to the obligations and responsibilities set out in this document, unless otherwise established by law.

11.3 This guarantee follows the provisions of the law and applies to claims for events that occurred in the period covered by the legal guarantee. For detailed information, please consult our Warranty Guidelines.

11.4 In no event shall we or our agents be liable for incidental or consequential damages, whether the claim is based in contract, warranty, negligence or product liability, including but not limited to loss of property other than the product itself , loss of use of any property or any other economic loss. Neither we nor any distributor or reseller will be liable in any way, nor will we be liable for payment or indemnification.

  1. Subcontracting and assignment

We reserve the right to subcontract, transfer, assign or replace all or some of our rights and obligations under these General Terms and Conditions, provided this does not affect your mandatory rights. You may not subcontract, assign or otherwise transfer any of your rights or obligations under these General Terms and Conditions without our written consent.

  1. European dispute resolution

European law requires all web shops to include the following link to the European Commission's online dispute resolution platform: https://ec.europa.eu/consumers/odr.

However, please note that Vision is not a member of an alternative dispute resolution body nor does it agree to use such a body. We aim to resolve any problems with our customers directly through our customer service (info@visionbeachtennis.com).

  1. Applicable Law/Jurisdiction

Unless otherwise required by law, these General Terms and Conditions are subject to the law of the country referred to in point 2.1., to the exclusion of the Vienna Convention on the International Sale of Goods (CISG) and conflict of laws rules.
